- Description: The main aim of this thesis is to establish whether affirmative action is justified and to consider the limitations imposed thereon. Regard had to be made to the past position, as affirmative action emanated from the apartheid era. This paper provides for an extensive discussion of what affirmative action entails and compares the past position of unfair discrimination towards the current position of affirmative action. It is important to have regard to the Constitution, legislation and case law relating to the application of affirmative action. Within this paper reference to the Constitution, LRA, EEA, case law, academic writings and journal articles is made in order to evaluate on what basis affirmative action is founded, justified and limited. The approach used in terms of substantive equality based on the Van Heerden1 and Harksen v Lane2 judgments. Provision is made as to whom affirmative action applies to. The process of implementation of affirmative action is visited with a view to give guidance on how affirmative action should be implemented, what the short comings are in the public sector with the implementation process and to provide guidelines to achieve a positive and effective affirmative action in South Africa Because certain people regard affirmative action as reverse discrimination, the contrary had to be analysed by way of legislation and authority from case law in order to provide for the correct position. It would become apparent from this paper that affirmative action does not only apply to designated employees, after the Van Heerden Judgment the courts have developed their approach in a number of authorities for example in Alexandre v Provincial administration of the Western Cape Department of Health3. India makes use of affirmative action that is in some instances similar to the South African approach. For a distinct reason I have chosen a comparison between India and South Africa. The reason is that, each individual’s personal circumstances that are to benefit from affirmative action have to be assessed before affirmative action applies to them. Further that I do not agree with the fact that a group as a whole should benefit, therefore recommendations have been made.

- Description: Companions provide support to women during the antenatal, labour, delivery and post-natal period. During labour and delivery women experience much pain as well as fear, tension and anxiety. Companionship during labour and childbirth can take the form of physical, emotional and psychological support provided by a loved one. Literature suggests that companionship during labour and delivery has a positive influence on women’s birth experiences and improves neonatal outcomes and breastfeeding. Despite the benefits of companionship, however, it is still found to be an uncommon practice in the midwife obstetric units (MOUs) in South Africa and elsewhere. The objectives of the study were to determine: the knowledge of women regarding companionship during labour and childbirth at MOU facilities in the Nelson Mandela Bay Health District (NMBHD) and the attitudes of women towards companionship during labour and childbirth at MOU facilities in the NMBHD.bmake recommendations to the NMBHD and MOU managers in order to enhance the practice of companionship during labour and childbirth. Ethical approval and permission were obtained from the relevant authorities prior to commencement of data collection of the study. Convenience sampling was used to select women from the target population. The research design was quantitative and descriptive. Questionnaires were used to collect data from delivered women at the five MOUs in the NMBHD. Data was collected from 130 delivered women at the five MOUs in the NMBHD between 4th December and 31st December 2018. Descriptive statistical analyses were utilised to analyse the collected data. Most delivered women 65.4% at MOUs in the NMBHD indicated they had knowledge about companionship during labour and childbirth. Majority of women 77.6% perceived companionship during labour and childbirth to be of importance. Some women were not aware of the purpose of companions as most women 39.2% disagreed that companions shorten length of labour, 45.8% agreed that companions monitor the progress of labour, 32.3% agreed that companions conduct deliveries. Most women 77.7% disagreed that companions as unhelpful, 65.4% are disruptive and 81.6% are affected by culture. However, 46.2% of the women in the study had no companion present during labour and childbirth, 56.2% preferred the presence of a female companion. Conclusions were made based on the research findings, that there is a need to educate and increase awareness to women regarding companionship during labour and childbirth so that they are more knowledgeable, and in order to strengthen the practice of companionship. Recommendations were made for more educational programmes to be available in antenatal services to increase awareness and enhance knowledge of women about companionship during labour and childbirth. Health educators need to conduct seminars, regular in-service training and include the concept of companions in the curriculum for midwifery students. Policies should be made available in the MOUs regarding companions, brochures or leaflets should also be available and accessible in all languages for the community to enhance awareness on the benefits of having a companion. Maternity registers should include information about companions in order to monitor the practice of companionship at the MOUs.

Knowledge management practices in a regional economic bloc secretariat: a case of Southern African development community

- Description: The effective application of appropriate Knowledge Management Practices (KMPs) is one of the innovative and creative ways for improving organisational work processes. Having been undertaken in a Regional Economic Bloc (REB) at the SADC Secretariat in Gaborone, Botswana, and at the SPGRC in Lusaka, Zambia, the study assesses KMPs among employees in these worksites. However, not all KMPs adopted can be appropriate. For example, studies show that the western epistemological perspective of knowledge that gives preference to leveraging explicit knowledge at the expense of tacit knowledge seems to be dominant in most organisations, just as evidenced in this study. This study was aimed at achieving to a limited extent exploratory and descriptive goal. The study was solidly grounded on the practice-based approach of knowing and learning in organisations, the OKC-SECI, and the dialogic Communication theories. It was aimed at assessing what, how and to what extent have KMPs utilized among REBs in the course of their day to day operations (SADC secretariat in particular). Using these theories, the study clearly shows how appropriate KMPs help improve secretariat’ work processes in any given REB secretariat’ everchanging work environment, and how it’s tested knowledge is stored, shared and applied as best practices. The study further assessed the conduciveness of the secretariat’s workplace environment in which such practices are carried out, and how appropriate the KM related ICTs available in that environment were. The theoretical underpinnings of the study were used to inform the selection of variables for the study. The approach of the study was firstly to understand what and how knowledge (both explicit and tacit) is generated, stored, shared and applied among the secretariat employees, and the focus was on the above theories. The study made use of the triangulated research approach to adequately capture and analyse both qualitative and quantitative data. By so doing, reliability and validity were enhanced. The copies of the questionnaire were administered to 138 employees of the catchment areas, and only 117 copies of the questionnaire were completed and returned for processing. From the returned copies of the questionnaire, 15 respondents whose responses vi appeared to have addressed the research questions were followed up for in-depth interviews. For qualitative data, the in-depth interviews were used together with the observation of the respondents’ behaviour, workplace environment and the appropriateness of the KM related ICTs available. Data obtained from the study were processed and analysed using SPSS for the quantitative data, while responses from the interviews and observations were sorted and coded. The process of comparing the processed quantitative and qualitative data resulted in the drawing of inferences that resolve the research problem. The study findings clearly show that the SADC secretariat was relatively good in the utilisation of appropriate KLPs; however, this was on average at a very low rate (32, 27.44%; Good), and mostly limited to the management of Information Resource Centres (47, 40.47%; Fair). This was followed by Explicit Knowledge Leveraging Practices (KLPs) (36, 30.75%; Good), while Tacit KLPs were rated the least with a (29, 25.20%; Bad) rating. The study findings further indicated that the conduciveness of the SADC secretariat workplace environment was on average fairly rated (61, 52.55%; Fair), with minimal opportunities for socialisation and collaborative work. The appropriateness of KM-related ICTs available at the secretariat was on average rated moderately at (41, 35.00%) Very good, though they were described as blind to the human, social and cultural aspects of KMPs. Finally, the study findings also revealed that the SADC secretariat was particularly rated bad (54, 45.87%) in finding possible KMP solutions, and was rated very good (51, 43.60%) in identifying the actual major challenges for managing KMPs. The use of a practice-based approach, OKC-SECI and Dialogic Communication theories to underpin the study were found suitable for investigating KMPs from a REB secretariat’s work processes context. The practice-based approach and the Dialogic Communication theory were particularly useful in addressing the issue of interaction, dialogue and sense-making in the workplace while the OKC-SECI theory helped understand knowledge conversion processes at the SADC secretariat. The findings of this study seem to propose that KMPs and KM, in general, can best be studied using a combination of methodologies because of the multi-disciplinary nature of the subject. The study, thus, proposes the “practice – theory – practice “knowledge creation and sharing workplace framework.

- Description: Knowledge has transformed to become an economic resource in a knowledge-based society, which determines the proficiency, progress and efficiency of any performed task. However, efficiency can be compromised when the health sector fails to retain the wealth of knowledge from experienced, senior and subject experts who have, or are about to leave or retire from the institution. Knowledge management provides for knowledge acquisition, sharing, transfer and further motivates the creation of influential atmospheres for knowledge sharing in the Public health sector. Healthcare is a knowledge driven process and thus knowledge management and the tools to manage knowledge in the healthcare sector are receiving attention. This study investigated knowledge retention practices in the Public health sector, Eastern Cape Province of South Africa. The study was informed by the Socialisation, Externalization, Combination, Internalization SECI model of knowledge creation and conversion by Nonaka & Takeuchi (1995) and the Knowledge based theory of the firm by Grant (1996). Both theories interpret knowledge sharing and preservation as vital for institutional growth and effective service delivery. The theories advised on the establishment of platforms designated for acquisition of new knowledge, knowledge sharing and retention to assist in future decision making to obtain a competitive edge. The study employed a mixed method approach that is largely quantitative in nature. Self-administered questionnaires were adopted for quantitative data collection and three interviews were conducted with middle management to supplement the quantitative data. The reliability and validity of the research instruments was achieved through adapting, and modifying questions from previously used research instruments from the works of Dewah, (2012); Teffo, (2014) and Tatani, (2015). New questions were further developed and evaluated through expert analysis. The study took place at Cecilia Makiwane Hospital in Mdantsane, Eastern Cape. The population of the study comprised of qualified healthcare workers in the health sector mainly “nurses”. The sample size was 198 and three interviews were conducted with the middle management to obtain qualitative data. xix The findings of the study revealed that the concept of knowledge retention was not dominant in public hospitals such as Cecilia Makiwane; however, certain practices are adopted to stimulate knowledge sharing thus contributing to knowledge retention. Several factors such as budget, ICT use, time allocation, fear of losing the competitive value through knowledge sharing and absence of supporting structures or services have been identified as root causes for reduced knowledge sharing practices among healthcare workers. The study, therefore, recommends the appointment of knowledge officers who would oversee the effective implementation of knowledge management policies and adopt strategies that will assist with knowledge retention. Further recommendations are, effective integration of knowledge management practices into the system, development of an internet based system for effective communication and institutional repositories for knowledge preservation. The study concludes that the development of training programs would assist healthcare workers to be familiar with any new or old invented mechanism.

The country’s immigrant population share relative to the total population stood at 2.4% in 1995 which soared to 7.6% in 2017. This increase has mostly been enticed by the highly competitive economic and political outlook of the rainbow nation in relation to other global developing nations. Unfortunately, reality of increased immigration particularly, labour-based immigration has spurred fierce debates which in many instances manifested into xenophobic violence. Pessimism amongst public, academic and political spheres continues to grow with detrimental economic strains of slow per capita income growth and high unemployment cited as immigration outcomes. The purpose of this study was to evaluate whether labour-based immigration contributed to changes in per capita income growth and unemployment levels in South Africa. Using unemployment rate, labour immigration entrances and per capita income growth rate data from 1994-2017, the autoregressive distributed lag (ARDL) bounds test was used to test for long run relationship together with the short run dynamic model. Evidence from the underlying results show that labour immigration has an insignificant causal effect on both per capita income growth and unemployment. Thus, contrary to pessimistic public and political sentiment, constrained income growth and increased unemployment are not attributed to high rates of labour immigration. Based on these findings policy makers should improve alignment of policies with regional and multinational blocs, constitutional obligations and economic goals to ensure sound immigration policies. Furthermore, communities should enable programs which aim to reduce tensions between immigrants and citizens whilst building towards inclusive development.

In the post-independence era, Zimbabwe undertook two phases of land reform – the first occurred between 1980 and 1999 and was known as the Land reform and Resettlement Programme (LRRP). This was based on the ‘willing-buyer and willing seller’. The second phase which took place from 2000, known as the Fast Track Land Reform Programme (FTLRP), took a radical approach. However, due to a variety of reasons, including the dominance of small-scale farming and challenges of land reform, agricultural productivity remains low. Moreover, despite land reform, including massive land redistribution, the process appears incomplete and inconclusive. This is so essentially because the land reform neither increased food production nor reduced poverty. Accordingly, sustainable development remains a distant reality, especially among rural small-scale farmers. The study aimed at assessing the impact of the fast track land reform (FTLRP) on poverty reduction and sustainable rural development in Zimbabwe. Despite undertaking one of Southern Africa’s largest post-colonial redistributive land reform to date, the provision of land on its own has not been sufficient to address rural poverty and achieving meaningful rural development. This is so because the land reform has not articulated integrated growth as remoteness and poverty remain endemic, which is connected to the land. So, resolving the land question still remains crucial for sustainable rural development in Zimbabwe.

Land rental policy and land market in Mashonaland East Province, Zimbabwe: implications on farmer decisions, efficiency and equity under A1 and A2 models

- Description: Government promulgated the land rental policy starting in the year 2007. The policy required that A1 (market residual) and A2 (indigenous commercial) farmers pay rentals to the state. Since then, there has also been an emerging trend in which farmers have been renting in and out land, resulting in an informal market for land rentals. The study therefore assessed farmers’ perceptions of land rental policy and evaluated the possible association of this policy to farmers’ decision making on land rental markets as well as its implications on farmers’ efficiency and equity. The study was carried out in Mashonaland East Province of Zimbabwe, covering two districts, Goromonzi and Marondera. The focus was specifically on A1 and A2 farmers, as the rental policy was directed at these resettlement models only and much of the informal land rental markets were prevalent among these categories of farmers. Data collection utilised the survey approach. This was supported by key informant interviews and focus group discussions, with a final sample of 339 households selected using multi-stage sampling method. Survey data were transcribed on CsPro 6, and analysed using Stata, SPSS and Frontier 4.1. Results showed that about a third of household respondents was from Marondera and twothirds was from Goromonzi, while 79% and 21% was A1 and A2 farmers respectively. About 80% was male headed households and the remainder was female headed households. About half of the households were not participating in land rental markets while the other half was split almost equally between those renting-in and renting-out land. In general, A2 farmers were better in agricultural productivity than A1 farmers. It was concluded that farmers had a fairly good knowledge of the agricultural land rental policy enunciated in the Finance Bills. A1 farmers were more knowledgeable than A2 farmers, but no vii significant differences were observed between male and female headed households and farmers involved and not involved in land rental markets. Farmers’ attitudes in relation to policy were categorised as fair, with significant differences based on gender and land market participation. Practice scores showed a poor adherence to policy for all categories of farmers. Overall perceptions of farmers on rental policy was inferred as fair with significant differences existing between land rental market participants and non-participants (autarky). The results of a bivariate Tobit model results showed that the decision to rent-in land was significantly influenced by gender, household income, permanent labour, cultivated area, tenure certainty, irrigable land size and crop diversification. On the other hand, age, permanent labour, irrigable land size and crop diversification significantly influenced farmers’ decisions to rent-out land. The conclusion was that household characteristics, land endowments and transaction costs significantly influenced the decision to rent-in land while the former two were strong in influencing renting-out decisions. Results from the linearized Cobb Douglas model showed that economic efficiency for most farmers was above 50%. Farmers renting-out land under A1 were found to be the most economically efficient, followed by those who were renting-in and least efficient were farmers not participating in land rental markets, though the differences were marginal. For the A2 model, renting-in farmers were the most efficient, followed by those in autarky position, while renting-out farmers were the least. Overall, the most efficient farmers were those renting-in, followed by those renting-out while farmers in autarky were the least efficient. Overall efficiency was higher for A2 farmers than for A1 farmers. For farmers not participating in rental markets, the sources of inefficiency were crop type, crop area and labour. For farmers renting-in, it was proportion of irrigable land, size of irrigable land, crop type, crop area and viii labour, while inefficiency drivers for renting-out farmers were crop type and associated area. Equity analysis showed that participation in land rental markets reduced inequality for farmers in the two districts and male and female headed households. Inequality was increased among A1 farmers and remained unchanged among A2 farmers. Overall, the emerging position was that participation in land rental markets resulted in higher efficiency and reduced inequality in land holding among the sampled farmers. It is recommended that government should be consistent on land rental policy and bring into place effective administration of land rental policy. Government may also consider formal acceptance of land rental markets in light of the marginal efficiency and equity benefits shown in the study. However, formalizing land rental markets alone may not be a panacea to improved efficiency and needs to be supported by other productivity measures given the average efficiency values for farmers. Crop and livestock production based on compatibility with the natural regions and defined minimum size of land should be encouraged to improve efficiency

The impetus for this study came after realising a decline in the academic achievement of learners as they move to higher levels of education. Taking into cognisance other factors like socio-economic background and marginalised communities, this study intended to investigate language practices at 3 primary schools at Standard 1, Standard 4 and Standard 7. Cases were selected from 3 various schools in different districts that present the language situation in Botswana. School A was in Kgalagadi district where the dominant spoken language is Shekgalagarhi, a minority language of Botswana. School B was in Southern district where the dominant spoken language is Setswana, the national language of Botswana and School C was in Gaborone city, the capital city of Botswana, where languages of Botswana come into contact and parents mainly use English to communicate with their children at home. Observation of language practices at these schools was the primary technique of data collection. The researcher also used questionnaires and focus group discussions for authentication. It was realised that whereas the language-in-education policy of Botswana is monoglossic, as it separates languages into separate functions, language practices in the three primary schools were transglossic, as they involved the use of different language varieties in the classroom. However, the researcher discovered that there was limited translanguaging that limited learner creativity and participation in class. The language practices revealed compliance and non-compliance of some schools to the national language-in-education policy. The researcher found language teaching to be one of the factors that limited content acquisition in content subject lessons. Realising the irrelevance of the policy to the linguistic needs of learners, this study proposes guidelines on the implementation of a multilingual micro policy that considers both the strong and the weak versions of translanguaging. This will open ways for translanguaging henceforth, active participation and enhanced performance for all Batswana. It also proposes the study of 3 languages: a minority language of Botswana, Setswana and English as compulsory subjects to embrace multilingualism and for the development of indigenous languages.

School A was in Kgalagadi district where the dominant spoken language is Shekgalagarhi, a minority language of Botswana. School B was in Southern district where the dominant spoken language is Setswana, the national language of Botswana and School C was in Gaborone city, the capital city of Botswana, where languages of Botswana come into contact and parents mainly use English to communicate with their children at home. Observation of language practices at these schools was the primary technique of data collection. The researcher also used questionnaires and focus group discussions for authentication. It was realised that whereas the language-in-education policy of Botswana is monoglossic, as it separates languages into separate functions, language practices in the three primary schools were transglossic, as they involved the use of different language varieties in the classroom. However, the researcher discovered that there was limited translanguaging that limited learner creativity and participation in class. The language practices revealed compliance and non-compliance of some schools to the national language-in-education policy. The researcher found language teaching to be one of the factors that limited content acquisition in content subject lessons. Realising the irrelevance of the policy to the linguistic needs of learners, this study proposes guidelines on the implementation of a multilingual micro policy that considers both the strong and the weak versions of translanguaging. This will open ways for translanguaging henceforth, active participation and enhanced performance for all Batswana. It also proposes the study of 3 languages: a minority language of Botswana, Setswana and English as compulsory subjects to embrace multilingualism and for the development of indigenous languages.

Such pelagic-coastal coupling indicates that changes in the trophic system during development can be transferred to the adult populations through changes in propagule supply. Thus, changes in environmental conditions can influence benthic populations directly (e.g. through larval advection) or indirectly, through their influence on the phytoplankton community (e.g. through the development of HABs). The South African coastline shows clear alongshore patterns of faunal biomass and species richness. On the south coast, strong longitudinal patterns of recruitment of intertidal organisms exist, with areas of particularly high recruitment. HABs of unprecedented spatio-temporal magnitude have recently developed along the south coast, including the areas where benthic recruitment is most intense. The present thesis used these blooms to study changes in intertidal recruitment directly or indirectly associated with their occurrence. Using a combination of remote sensing data to study the environmental conditions of the water mass in the innermost part of the Agulhas Bank, and estimates of mussel and barnacle recruitment rates to integrate the effects of conditions in the water mass during larval development, this thesis aimed to: (1) understand the conditions that triggered the development of an HAB of the dinoflagellate Lingulodinium polyedrum during summer of 2014, (2) determine the direct or indirect effects of that bloom on recruitment of intertidal organisms, and understand the factors that affect recruitment along the coast, (3) determine if the environmental factors during bloom development produced any carryover effects on recruit growth and mortality, and (4) determine the factors that drive changes in community biomass and composition along the south coast, the long-term trends in those factors, and possible changes experienced in recent years. Water column stability during spring, before the development of the red tide, followed by alternating periods of upwelling and relaxation during summer and autumn, seemed to promote the development and persistence of L. polyedrum. Recruitment of mussels and barnacles was estimated during the reproductive season of mussels in 2014, coinciding with the red tide, and during the following year. Alongshore patterns in recruitment were found, with higher mussel recruitment in the absence of the red tide and the opposite pattern in barnacles. Alongshore patterns in SST and chlorophyll matching those of recruitment were also found, with higher SSTs and lower chlorophyll during the red tide than the following year. Growth and mortality rates in barnacles did not differ between years during the first five months after settlement. This suggests that the factors which produced differences in recruitment between years did not produce carryover effects detectable at the temporal scales studied. Further analysis of 15 years of satellite-derived environmental data showed significant cooling trends potentially driven by a long-term seasonal acceleration of the Agulhas Current in autumn around two upwelling centres on the south coast, coinciding temporally with the reproductive period of mussels and barnacles, and spatially with the areas of highest recruitment. In addition, the comparison of SST and chl-a conditions during the first and the second half of the period of study showed that seasonality of both variables has changed in large areas over the shelf, with increasing importance of shorter-term variability, which would in turn decrease environmental predictability. Thus, the conditions observed during the present study, particularly during 2015, when upwelling seemed to be more intense, may presage the potential effects of identified long-term cooling trends at the upwelling centres. Although the general trend shows cooling around those areas, conditions can vary greatly among years, favouring different taxa. Changes in the Agulhas Current System are affected by changes in distant areas in the Indian Ocean basin. Such tele-connection is unlikely to be unique to this system and indicates the importance of understanding trends in major large scale climatic drivers and their regional effects in order to make predictions about coastal systems.

Laser welding of thin-walled stainless steel tubing

- Description: Longitudinal butt welds in the motor industry are increasingly being made by laser welding. One of the materials being welded is thin walled type 441 stainless steel tubing. The welding process parameters should however be optimised to give a weld that possesses acceptable properties. In this research, a Yb:YAG laser machine was used to weld a 1.2mm thick tubing. Laser power and welding speed were varied to achieve an optimum weld whose properties compare well with the parent metal. The two parameters were combined such that the heat input was in the range of 7.5 to 25kJ/m. The welds were characterised by the microstructure from the weld, intergranular attack and mechanical properties. It has been shown by microstructure study that grains originated from ‘weld metal/base metal’ interface and elongated towards the weld centreline. A defined line ran through the interface through the thickness of the plate. Smaller grains were noted around the interface in some welds. Susceptibility to intergranular attack tests showed random ditching in the weld metal microstructure which indicated that the weldments produced were acceptable. Mechanical tests of all welds showed a slight increase in micro-hardness in the weld metal. While the base metal had a micro-hardness range of 160 –199HV0.1, it increased to 187 – 242HV0.1 in the fusion zone. An ANOVA regression of tensile test results predicted an expected maximum of 471MPa to occur when a 1000W power is used at a welding speed of 0.06m/s. Fracture morphology of tensile test samples showed that all failures were by overload. This showed that the weld metal still exhibited similar ductility properties with the base metal.

This is evident by the increase in the number of studies on the topic of leadership. Organisational leaders are responsible to oversee the company’s operations including the allocation of resources, people management and to facilitate process integration to enable the organisation to achieve its stated objectives. State-Owned Enterprises (SOEs) such as Eskom has a mandate to provide infrastructure services to improve the country’s economic conditions. In particular, Eskom is responsible for electricity generation, transmission and distribution in South Africa and other neighbouring counties. Infrastructure development is much needed in South Africa (SA) to enable the country to attract investors and to grow local businesses, as its economy was downgraded to one notch above‘junk status’ in June 2017 (Mutize & Gossel, 2017). Apart from social responsibility, SOEs are required to operate efficiently in line with good corporate governance and become self-sufficient to fund their own future growth plans. Hence, the importance of SOEs to improve their own performance and efficiencies. In the past few years, Eskom has underperformed in meeting its key deliverables as stipulated in the shareholder compact. These include the electrification of households, maintenance of the current infrastructure and the building of excess electricity capacity. The poor performance has negatively affected the country economy due to planned outages when trying to balance electricity demand and supply. It has further contributed to ongoing community service delivery protests, which costs the country millions of rands (Kekana, 2017; Nyembezi, 2015). In the same period, the company faced many leadership changes which partly contribute to its not fully implementing its strategic plans. The objective of this study was to contribute to a possible improvement in Eskom’s performance by examining the influence of leadership on organisational performance, using the independent variables of the leadership conduct (authenticity), work support and performance determinants (culture, communication, change management, strategy implementation and talent management) and further to add to the current literature in explaining how leadership influences performance. - Description: The study highlighted the importance of leadership and employee engagement in LEAN manufacturing. Dombrowski and Mielke emphasised the critical importance of leadership as a cornerstone for stimulating employee engagement in continuous improvement systems. It was also noted that leadership was listed as either the key failure factor or key success factor for LEAN Implementation. This study confirmed that LEAN Leadership behaviours have a definite effect on employee engagement. The LEAN Leadership Model was tested on employee engagement in a Fast Moving Consumer Goods (FMCG) confectionery plant in Port Elizabeth, South Africa. Two mail surveys were used. The first survey was directed towards shop-floor factory operators, which included 141 respondents. This figure was greater than 50% of the target population. The survey tested for employee engagement (dependent variable) and the operator’s perception of their line manager behaviours (independent variables). The second survey was directed towards line managers, which included 8 respondents, providing 100% of the desired population. The survey for the line managers requested them to respond to their own engagement, as well as their perception of their own leadership behaviours. The study aimed to answer three research questions related to: The effect of LEAN Leadership behaviours on employee engagement. The suitability of the LEAN Leadership Model for promoting employee engagement. Whether or not the perception of shop-floor employees met the perception of line managers on leadership behaviours. In answering the first research question, the descriptive statistical analysis showed that LEAN Leadership behaviours have a positive influence on employee engagement. This was confirmed using a Pearson Correlation Test and the ANOVA Test amongst the different line managers. The findings correlated with studies reviewed in the literature chapter. The second research question asked whether the LEAN Leadership Model was a suitable framework for employee engagement or not. It was found that the hypothesised framework was not validated. Through conducting an EFA and mediating variable test, a new model i.e. The LEAN Leadership – Employee Engagement Model was constructed. The model comprised of two independent variables (Authentic Improvement Culture and Hoshin Kanri), one mediating variable (Gemba Qualification) and one dependent variable (Employee Engagement). Overall, the LEAN Leadership - Employee Engagement Model suggested that line managers were able to promote employee engagement by spending time with employees and recognising them on the shop-floor. The model also showed that Authentic Improvement Culture leadership behaviours and strategic management behaviours (Hoshin Kanri) had a direct positive influence on employee engagement, while they also indirectly worked through the Gemba Qualification to positively influence engagement. It is worth mentioning that the role of the Team is the centre of the LEAN Leadership Model, from which the LEAN Leadership – Employee Engagement Model was derived. It is important that the role of the team in LEAN methodologies, and the behaviours that promote teamwork amongst the shop-floor employees, does not lose focus. The final research question on whether or not shop-floor perceptions met line manager perceptions regarding line manager behaviours was also answered through a Two Sample T-Test. Large effects in perception were not apparent regarding Authentic Improvement Culture behaviours. With regard to the Gemba Qualification and Hoshin Kanri, line managers felt that they displayed more of these behaviours than what was perceived by their shop-floor employees. Overall, large effects showed that in some cases, perceptions differed. This had the potential to influence shop-floor employee engagement. The findings from this research study provided a management solution and an academic contribution to influence and correct leadership behaviours to aid sustainable LEAN Implementation. In addition, the findings could be used to troubleshoot stagnations in LEAN phase executions from a possible lack of employee engagement.

Learning to learn: a critical realist exploration into the home established learning practices of a marginalised community in Port Elizabeth

- Description: This study was completed as part of a project exploring social inclusion and exclusion in South African higher education. In a globalised world, the achievement of a qualification from an institution of higher education is increasingly key to finding any sort of employment. This is particularly the case in South Africa where employment amongst black citizens is inordinately high. The aim of the research reported upon in this thesis was to better understand the construct of ‘epistemological access’ (Morrow, 1992), often used in relation to the needs of black working class students entering higher education, in relation to performance data (see for example, CHE, 2016) that repeatedly shows that black students fare less well than their white peers. Following what might be termed a ‘social’ approach to understanding access, this study begins long before most students have even heard of higher education and focuses on identifying the mechanisms that come into play at much earlier level of learning and literacy development. The study outlines the development of ‘ways of being’, or social practices, surrounding learning in a marginalised community in Port Elizabeth, in the Eastern Cape, South Africa. This was achieved by means of critical ethnography and it is therefore qualitatively based. The study shows how social structures enable or constrain a child’s school readiness and how they then go on to support or impede progress in school where the language and literacy needed for educational success are further developed. The study therefore aims to allow us to explain global data indicating that the single greatest indicator of a young person’s ability to access and succeed in higher education is the level of education of caregivers in their homes of origin. Examined from a critical perspective (i.e. with a concern for social justice), this study has made use of a framework using social, psychological and linguistic theory and more, particularly, the work of sociologist Margaret Archer (1995, 1996, 2003). The study makes particular use of Archer’s ‘morphogenetic framework’ which allows for an analysis of the way structure and culture impact on a child’s development over time. As I was concerned that my own social status might impact on the understandings I developed as a critical ethnographer, the study acknowledges my own experiences of learning and the way my own family sought to enhance them as enabling. In doing this, the study aims to better contribute to understandings of social justice in South Africa.

- Description: This paper focuses on the legal position of employees of a Temporary Employment Services (hereinafter referred to as “TES”), also referred to as a labour broker defined as a person or entity that provides workers to others, (their clients) to perform duties for the benefit of the client for compensation. This tripartite relationship is established by an employment contract between the employee and the TES (this forms the basis of the employment relationship) and a commercial contract between the TES and the client. This relationship is regulated by S198 of the Labour Relations Act1 (hereinafter referred to as “LRA”). This section provides protection to employees of a labour broker, where before it, such protection did not exist. This section along with its subsections will be discussed in length in this paper and this section will be criticized and its shortcomings will be highlighted. Due to S198’s shortcomings, The South African Government introduced proposed amendments to the LRA (hereinafter referred to as “LRAA”).2 These proposed amendments and the effect thereof on TES are studied to determine whether it will better the current issues experienced with TES. The amendments provide difficulty in its interpretation, particularly S198A (3) (b), also referred to as the deeming provision. This paper will study the amendments and its subsections. S198A(3)(b) is problematic in its interpretation because due to the manner in which it is drafted, strong arguments can be made for either a sole employment interpretation or a dual employer interpretation. The main focus of the paper will be to study provisions of S198 (A) (3) (b) and look at who the employer is, of employees in a TES relationship, between the TES and the client. This question will also ultimately indicate what the legal position is of employees in TES relationship. This paper will also look at how courts have interpreted the deeming provision and their findings will be highlighted and criticised.

Legal remedies against corruption: lessons from Guatemala

- Description: Corruption is a crime which has affected all levels of government in South Africa. Despite the multi-agency system developed since the advent of democracy, levels of corruption are still on the rise, with greater levels of impunity. It is clear that reform is needed within South Africa’s anti-corruption framework. The state of Guatemala has meanwhile achieved results that have been described as transcendental in the fight against corruption, via a novel anti-corruption commission formed in collaboration with the United Nations, known as the Commission against Impunity in Guatemala (CICIG). This dissertation begins with an examination of the content of the crime of corruption via a historical approach – charting the course of corruption and effort to curb it from Ancient Greece, Mesoamerica and Africa, through the various legal systems that have resulted in the modern-day legal frameworks of South Africa and Guatemala. In doing so, a working definition of corruption has been developed – namely the unlawful and unethical enrichment of the self at the expense of the state. This definition aids in clearly defining proven instances of corruption within the public sector in modern South Africa. While corruption as a crime is generally clandestine in nature and difficult to deal with quantitatively, it is clearly demonstrated from the instances of corruption that have been proven that the offence is dealt with ineffectually by the existing policy and legal framework. Examinations of corruption scandals such as the capture of the state by private family corporations, to the collapse of South Africa’s Social Security Agency (SASSA), show that even when proven, corrupt politicians rarely face consequences for their actions. This is due to the lack of clarity in the primary legislation dealing with corruption – the Prevention and Combatting of Corrupt Activity Act (PRECCA), combined with a multi-agency approach wherein the various bodies tasked with combatting corruption are not working cohesively. The solution to this problem is a single commission to integrate the anti-corruption framework, as well as providing a fresh perspective about how to deal with the crime. The CICIG has served this role in Guatemala, resulting in successful investigations and prosecutions of former Presidents, judges and members of the legislature. It has achieved this by supporting and working with the existing anti-corruption bodies, as well as advising government on effective policy reform. It is further staffed by anti-corruption experts who are from the Central and South American region, providing a level of trust and regional knowledge. There is no bar in South African law for the creation of a similar international body. Such a move is necessary to provide a fresh outlook on the fight against corruption in South Africa. An international body, staffed by African anti-corruption experts, would be an effective means to work with the multi-agency system currently in place to aid it in working cohesively, but also to provide African solutions to the scourge of corruption through policy reform.
